William M. Low practices in the areas of complex tort and business litigation, with a current emphasis on professional liability, privacy, information security, product liability, and healthcare. Mr. Low also serves as general counsel for the firm where he regularly advises our lawyers on issues related to ethics, conflicts of interest and professional responsibility. He has also served as expert witness in legal malpractice cases.

Mr. Low began his legal career in 1982 at the premier civil trial firm in San Diego—McInnis, Fitzgerald, Rees, Sharkey & McIntyre. In 1988 he became a partner in the McInnis firm and served as its managing partner when it merged with Higgs Fletcher & Mack in 1999.

While at the McInnis firm, Mr. Low handled a wide range of cases beginning with the defense of general and professional liability lawsuits. His practice quickly grew to include insurance coverage, insurance bad faith, medical malpractice, business litigation, and product liability cases. After joining Higgs Fletcher & Mack, his practice continued to expand, particularly in the area of product liability defense. This included defending Metabolife International, Inc. for a period of seven years in hundreds of dietary supplement product liability lawsuits filed throughout the U.S. over its flagship product, Metabolife 356, that was alleged to have caused or contributed to heart attacks, seizures, and strokes in consumers who were taking that product. In that capacity, Mr. Low served on the MDL Defendants Science Committee. He played an active role in the selection and retention of defense experts, and participated in the cross-examination of plaintiffs’ experts in depositions and at a Daubert hearing, challenging the admissibility of plaintiffs’ expert opinions.

He also defended another dietary supplement maker in more than 40 product liability lawsuits filed in California over a three-year period that alleged the dietary supplement had been adulterated with pharmaceutical drugs.

Mr. Low has distinguished himself in both state as well as federal courts and has tried to verdict a wide variety of cases including catastrophic injury, professional liability, medical and nursing board hearings, insurance bad faith, product liability, probate and trust, employment discrimination, and sexual harassment.

Mr. Low has devoted substantial time and effort to the rapidly expanding area of law involving privacy and cybersecurity. He currently chairs the Privacy and Information Security Practice Group at Higgs Fletcher & Mack and is a member of the International Association of Privacy Professionals (IAPP). He is also a Certified Information Privacy Professional (CIPP/US).

Mr. Low is honored to have been invited to be a member of two of the most prestigious trial lawyer organizations in the country. He is a Fellow in the American College of Trial Lawyers, an association of trial lawyers founded in 1950 which recognizes and honors trial lawyers in the United States and Canada. Membership in the College is by invitation only, after an intensive investigation to confirm that a candidate is a truly outstanding trial lawyer who demonstrates the highest degree of professionalism, ethics, and civility. Fellows must have been active in the trial practice for at least 15 years and be recognized as among the very best trial lawyers in their state or province by the judges they practice before and the opponents they try cases against. Admission to the American College is limited to the top one percent of lawyers in each state or province.

He is also a member of the American Board of Trial Advocates (ABOTA), the premier association of American trial lawyers. ABOTA is a national association of experienced trial lawyers and judges dedicated to the preservation and promotion of the civil jury trial right provided by the Seventh Amendment to the United States Constitution. Membership in ABOTA is by invitation only. In 2007, Mr. Low served as President of the San Diego Chapter of ABOTA. Most recently, he served as a demonstrator for the San Diego ABOTA Chapter’s Trial by Masters (opening statement—defendant).

In 2016, he received the Daniel T. Broderick III Professionalism and Civility Award, which recognizes a San Diego attorney who demonstrates the highest levels of civility, integrity and professionalism.

Mr. Low is honored to have been selected by his peers for inclusion in The Best Lawyers in America continuously since 2007. In 2012 he was named Best Lawyer of the year in San Diego in the area of Medical Malpractice—Defendants. In 2015, he was included in Best Lawyers in America for San Diego in the areas of Product Liability Litigation—Defendants, Personal Injury Litigation–Defendants, and Medical Malpractice Law–Defendants. Mr. Low has received the highest rating available “A-V Preeminent” from Martindale-Hubbell for ethics and legal ability.

He is Master in the Welsh Chapter of the American Inns of Court and a member of its Executive Committee; a former Director and President of the San Diego Inn of Court as well as a frequent demonstrator—closing argument and cross examination—for its annual College of Advocacy; a member of the Steering Committee of the San Diego ESI Forum; and a member of the Association of Business Trial Lawyers. Additionally, Mr. Low is an Eagle Scout, a former Scoutmaster, has served on Eagle Scout Boards of Review for over 25 years, and has coached youth soccer and Little League baseball. He has been a Magician Member of the Academy of Magical Arts Inc. (“Magic Castle”) for over 30 years and performed close-up table magic at the Atlantis restaurant on Mission Bay in San Diego during his first and second years of law school. He enjoys sailing, skiing, backpacking, and traveling with his family.

  • Successful defense of a physician in a case brought by an ALS patient who sued his doctor for keeping him alive—allegedly against the patient’s wishes. The case generated international news coverage and was broadcast by Court TV.
  • Successful defense of a hospital that had been sued when an elderly patient tragically caught fire and burned to death in her hospital bed.
  • Successful defense of trustees of several family trusts in a probate and trust lawsuit brought by family members in which the petitioners sought over $200 million in monetary damages, in addition to punitive damages.
  • Successful defense of a regional utility company in an extremely tragic wrongful death case brought by the parents of a 17-year-old driver who lost control of her vehicle that left the roadway and struck a gas main, causing the vehicle to erupt in flames and killing the driver.
  • Successful defense of a hospital which had been sued by a patient seeking $12 million in damages after she experienced postoperative complications resulting in the loss of both legs below the knee and several fingers.
  • Successful defense of a bar owner/manager who was sued in a sexual harassment lawsuit brought by two female bartenders alleging they had been verbally and physically harassed.
